Terms of Service

These terms cover use of the Holdfast Driving software, provided by Holdfast Driving (“we”, “us”). By creating an account, whether as a business owner, an instructor, or a pupil, you agree to these terms.

What Holdfast Driving is

Holdfast Driving is booking, scheduling, and payment software for driving instructors and schools. We provide the platform; the driving school or instructor you book lessons with is responsible for the actual driving tuition, its quality, and its safety. We are not a driving school and do not employ instructors.

Accounts

You're responsible for keeping your account credentials secure and for activity that happens under your account. You must provide accurate information when creating an account, and keep it up to date.

Bookings and payments

When a pupil books a lesson, Holdfast Driving charges the lesson cost at the time of booking, first from any prepaid balance, then from a saved card via Stripe for any shortfall. Each business customer sets their own cancellation and no-show policy, shown to the pupil when booking. Where a lesson is cancelled with enough notice, the amount is credited back to the pupil's balance for a future lesson; where it's a late cancellation or no-show, the school's stated policy determines how much is kept.

All card payments are processed by Stripe. Instructor payouts are made directly to the instructor's own Stripe Connect account. Holdfast Driving facilitates these payments through Stripe but is not a party to the underlying transaction between pupil and instructor.

Prepaid balances and gift cards

When you top up a balance, buy a lesson package, or redeem a gift card, that value is added to your account for use against future lessons with the relevant business customer, and is not a purchase of digital content you receive from us directly. Because that value stays usable and doesn't expire unless the business customer has set an expiry date on a specific gift card or promotion, you don't get a statutory 14-day cancellation right over the top-up itself; your cancellation and refund rights for the lessons it's spent on are set by the business customer's stated cancellation policy, described above. If a business customer closes their account, contact them directly about any remaining balance; if that's not possible, contact us and we'll do what we reasonably can to help.

Subscription fees

Business customers choose one of the following plans, billed via Stripe:

  • Free — no monthly fee, plus a 3% + 20p platform fee on payments processed through Stripe.
  • Pro — £15/month flat fee for a single instructor, plus a reduced 1.5% + 20p platform fee.
  • School — £15/month for the first instructor, plus £3/month for each additional instructor, with a 7-day free trial.

Fees may change with reasonable notice. You can cancel a paid plan at any time; access continues until the end of the current billing period.

Acceptable use

You agree not to use Holdfast Driving for anything unlawful, to misrepresent who you are, to abuse the support or messaging features, or to attempt to disrupt or gain unauthorised access to the platform.

Data protection

Our Privacy Policy explains what personal data we collect and how it's used. Business customers are the data controller for their own pupils' personal data; we process it on their behalf to provide the service, under the terms of our Data Processing Agreement, available on request.

Liability

Holdfast Driving is provided “as is”. We work to keep the service reliable and accurate, including drive-time estimates and no-show/cancellation charge calculations, but we don't guarantee it will be uninterrupted or error-free. We're not responsible for the conduct, quality, or safety of driving tuition provided by a business customer or instructor, which remains their responsibility. To the extent permitted by law, our liability for any claim relating to the service is limited to the fees you've paid us in the 12 months before the claim arose.

Nothing in these terms limits liability where it would be unlawful to do so, such as for death or personal injury caused by negligence, or for fraud.

Termination

You can close your account at any time. We may suspend or terminate an account that breaches these terms, misuses the platform, or where required by law. We'll try to give reasonable notice where practical.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll let business customers know so they can pass that on to their pupils. Continuing to use the service after a change means you accept the updated terms.

If something goes wrong beyond our control

We're not liable for failing to meet our obligations here where that's down to something reasonably outside our control, such as an outage at a provider we depend on (Stripe, our hosting provider, or similar), an internet or power failure, or another event of that kind. We'll work to restore the service as soon as we reasonably can.

Transferring these terms

You can't transfer your rights or obligations under these terms to someone else without our agreement. We may transfer ours, for example as part of a merger, acquisition, or sale of assets, provided that doesn't reduce the protections you're entitled to under this agreement.

If part of these terms turns out to be unenforceable

If a court finds part of these terms invalid or unenforceable, the rest continues to apply. These terms, together with our Privacy Policy, are the whole agreement between you and us about your use of the service, and replace anything discussed beforehand.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except that if you're a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Nothing here affects your statutory rights as a consumer.
